YouTube API Services Agreement

Pixel Play uses YouTube API Services. By using our application, you are agreeing to be bound by:

1. Agreement to Terms

Welcome to Pixel Play, a music streaming application operated by Creative Pixels ("Company," "we," "our," or "us"). By accessing or using our service, you agree to be bound by these Terms of Service ("Terms").

Important: Please read these Terms carefully before using Pixel Play. If you do not agree to these Terms, you may not access or use our service.

2. Service Description

Pixel Play provides:

  • Music streaming through YouTube integration
  • Local audio file playback
  • Lyrics display functionality
  • User authentication via Google Sign-In
  • Guest access mode
  • Background playback on mobile devices (where supported)

We reserve the right to modify, suspend, or discontinue any aspect of our service at any time without notice.

3. User Accounts and Registration

3.1 Account Creation

You may create an account using Google Sign-In or use our service as a guest. By creating an account, you warrant that:

  • You are at least 13 years of age
  • All information you provide is accurate and current
  • You will maintain the security of your account credentials
  • You will immediately notify us of any unauthorized access

3.2 Account Responsibility

You are responsible for all activities that occur under your account. You agree not to share your account credentials with others.

4. Acceptable Use Policy

4.1 Permitted Use

You may use Pixel Play for personal, non-commercial purposes only.

4.2 Prohibited Activities

You agree NOT to:

  • Use the service for any illegal purpose or in violation of any laws
  • Attempt to bypass, disable, or interfere with security features
  • Use automated systems (bots, scrapers) to access the service
  • Upload or share malicious files or code
  • Violate intellectual property rights of others
  • Harass, abuse, or harm other users
  • Attempt to reverse engineer or decompile any part of the service
  • Use the service to distribute spam or unsolicited messages
  • Impersonate any person or entity
  • Download YouTube content in violation of YouTube's Terms of Service

5. Content and Intellectual Property

5.1 User-Uploaded Content

When you upload local audio files, you represent and warrant that:

  • You own or have the necessary rights to the content
  • The content does not violate any third-party rights
  • The content does not violate any laws or regulations

We do not claim ownership of your uploaded files. Files are stored locally on your device only.

5.2 YouTube Content

All YouTube content accessed through Pixel Play is subject to YouTube's Terms of Service. You agree to comply with all YouTube policies and not download or distribute YouTube content in violation of their terms.

5.3 Our Intellectual Property

Pixel Play's design, code, graphics, logos, and other materials are owned by Creative Pixels and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

6. Third-Party Services and YouTube API

Pixel Play integrates with third-party services including:

  • YouTube API Services: Music search and video streaming
  • Google OAuth: User authentication
  • Lyrics.ovh: Lyrics fetching

Pixel Play uses YouTube API Services. By using Pixel Play, you expressly acknowledge and agree to:

We are not responsible for third-party services or their content. Your use of YouTube content is subject to YouTube's Terms of Service.

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimers and Limitations of Liability

8.1 "AS IS" Service

PIXEL PLAY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of non-infringement
  • Warranties regarding availability, reliability, or quality
  • Warranties that the service will be uninterrupted or error-free

8.2 Content Disclaimer

We do not control or endorse content available through YouTube or other third-party sources. We are not responsible for the accuracy, legality, or appropriateness of third-party content.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATIVE PIXELS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, or goodwill
  • Service interruptions or errors
  • Unauthorized access to your data
  • Third-party conduct or content

Our total liability shall not exceed $100 USD or the amount you paid us in the past 12 months (whichever is greater).

9. Indemnification

You agree to indemnify, defend, and hold harmless Creative Pixels and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of Pixel Play
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you upload or share

10. Termination

10.1 Termination by You

You may stop using Pixel Play at any time by logging out and clearing your browser data.

10.2 Termination by Us

We reserve the right to suspend or terminate your access to Pixel Play at any time, without notice, for:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Any reason at our sole discretion

10.3 Effect of Termination

Upon termination, your right to use the service will immediately cease. Any locally stored data will remain on your device until you clear it.

11. Dispute Resolution

11.1 Informal Resolution

If you have a dispute with us, please contact us first at support@creativepixels.in to attempt informal resolution.

11.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

11.3 Jurisdiction

Any legal action or proceeding relating to these Terms shall be brought exclusively in the courts located in India, and you consent to the jurisdiction of such courts.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

  • Updating the "Last Updated" date
  • Posting a notice on the service
  • Sending an email notification (for registered users)

Your continued use of Pixel Play after changes constitutes acceptance of the modified Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on Pixel Play, constitute the entire agreement between you and Creative Pixels regarding the service.
